EMPIRE has a long history, going back at least to 1999, I believe. I saw a very early reading of this, and while a lot of work has been done, it hasn't been work that improved the musical markedly. EMPIRE has also passed through various producers hands. And there have always been wealthy people circling it willing to write checks for the next step. Its dead mid-summer. A dreadful time to open a show in New York. NWS had an empty theatre, of course they're going to take the rental. With my cynical hat on, I imagine that the Shubert Org knew that this show wouldn't have legs, and they would have their theatre back for other shows in the Fall. Yes - theatre owners actually do that. They're in business. I would imagine that EMPIRE might continue to pop up places, because those behind it have a legacy of 25 years of belief in this project - and money to get productions done every 6 or 7 years. Sadly, the basic premise of the show has never really worked. And critics see a lot of really bad shows every year. Sometimes one understandably just snaps.
