This is still more than a grey area. Dramatists Guild Approved Production Contracts agreements for new plays are very clear that the author owns the play. No changes, additions, cuts can be made without their approval. The DG APC (approved production contract) is also clear that any suggestion that may lead to a line change, a new line, or a cut line etc, whether by an actor or a director or a designer or a producer etc etc becomes the property of the author. This is not negotiable. What has happened, as I'm sure you know, is that the Broadway contract now has a clause in their Developmental Agreement allowing AEA members who participate in Tier 3 work sessions (Full workshops of Broadway shows) share in 1% of the entity's net profits after 110% recoupment. (The Entity is the Broadway production LLC. Tours * London etc may pay license fee back to the original company, but those additional companies are separately financed) I don't believe there s a similar clause for a Broadway production contract. And it very clear that no one has ownership of the script other than the author, in any case. Any contingent money earned for participation by AEA members or others comes from the Producer's share of profits. One could start company developed project in a different way, with the author credit being set from day one as the author + cast (+ director), all sharing in a part of royalties in perpetuity, and being co -authors. I don't know of that being done ... |
